1. Acceptance of This Agreement

By accessing or using any website, application, course, product, or service (collectively, the “Services”) provided by Serenity Now Foundations ("SNF," "we," "us," or "our"), you (“you” or “User”) acknowledge that you have read, understood, and agree to be bound by this Combined Terms of Use & Privacy Policy (“Agreement”).
If you do not agree, do not access or use the Services.

2. Definitions

Site – any domain or sub‑domain owned or controlled by SNF, currently including https://serenitynowfoundations.com and linked pages.

Content – all text, graphics, audio, video, downloads, courses, and other materials made available through the Services.

Personal Data – information that identifies or can reasonably be linked to an identifiable natural person.

Lifetime Access – access to purchased course material for as long as (a) the relevant course remains offered on SNF’s platform and (b) SNF continues operational business activities. Lifetime Access ends automatically if either condition ceases.

3. Scope

This Agreement integrates and supersedes SNF’s prior separate “Terms of Use” and “Privacy Policy.” Any references in existing documents to those policies now refer to this Agreement.

PART A – PRIVACY & DATA PROTECTION

4. Information We Collect

Information You Provide: name, email, mailing address, demographic data, payment details (processed by third‑party gateways), survey responses, support requests, and any content you submit (e.g., forum posts).

Automatically Collected Data: IP address, browser type, device identifiers, referring URLs, pages visited, and timestamps, collected via server logs, cookies, pixels, and similar technologies.

5. How We Use Information

We process Personal Data to: deliver, maintain, and improve the Services; personalize Content and marketing; process transactions and send transactional communications;

detect, investigate, and mitigate fraud or security incidents; comply with legal obligations and enforce our rights.

SNF never sells or leases Personal Data. We may share data with trusted processors (e.g., payment gateways, email service providers) under confidentiality agreements strictly for the purposes above.

6. Cookies & Similar Technologies

We use functional, analytical, and marketing cookies to recognize returning Users, remember preferences, and analyze traffic. You can disable cookies in your browser, but parts of the Site may not function correctly.

7. Children’s Privacy

The Services are not directed to children under 18. We do not knowingly collect Personal Data from anyone under 18. If we learn we have done so, we will promptly delete such data.

8. Data Security & Breach Notification

SNF employs industry‑standard administrative, technical, and physical safeguards. No system is impenetrable; therefore, we cannot guarantee absolute security. In the unlikely event of a data breach affecting Personal Data, we will notify impacted Users by email within 72 hours, unless delayed by law‑enforcement requirements.

9. Your Choices & Rights

Opt‑out of marketing emails at any time via the unsubscribe link or by emailing [email protected]

Access, correct, delete, or port your Personal Data by contacting us (Section 26). We may need to verify your identity.

PART B – TERMS OF USE

10. Intellectual Property

All Content is owned by SNF or its licensors and protected by Canadian and international intellectual‑property laws. Subject to your compliance with this Agreement, SNF grants you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Content for your own non‑commercial purposes. No other rights are granted. You may not copy, modify, sell, exploit, or create derivative works from the Content without express written permission.

11. User Conduct

You agree not to: Violate any applicable law or regulation; Upload, post, or transmit unlawful, harmful, harassing, defamatory, or obscene material; Infringe intellectual‑property or privacy rights; Introduce malware or attempt unauthorized access to the Services; Use automated means (scrapers, bots) to collect data or interfere with the Services; Impersonate any person or entity.

12. Purchases, Fees & Refunds

Pricing is listed in US dollars unless otherwise noted and excludes taxes.

Payment Processing – handled by third‑party providers; SNF does not store full credit‑card numbers.

Refunds – Unless a product‑specific guarantee applies, all sales are final after 7 days from purchase. Refund requests within 14 days are considered case‑by‑case at SNF’s sole discretion. Processing fees are non‑refundable.

13. Electronic Communications

You consent to receive electronic communications (emails, in‑app messages, notices) from SNF. You may withdraw consent by terminating your account and ceasing use of the Services.

14. User Submissions

Any ideas, feedback, or materials you submit become SNF’s exclusive property, with no obligation of confidence or compensation, unless otherwise agreed in writing.

15. Medical Disclaimer

The Services provide educational information only and are not a substitute for professional medical, psychological, legal, or financial advice. Individual results vary; SNF makes no guarantees of income, health, or other outcomes.

16. Warranty Disclaimer

The Services and Content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. SNF disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant uninterrupted or error‑free operation.

17. Limitation of Liability

To the fullest extent permitted by law, SNF, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. SNF’s total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to SNF in the 12 months preceding the claim.

18. Indemnification

You will defend, indemnify, and hold harmless SNF and its stakeholders from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to your: (a) use or misuse of the Services; (b) violation of this Agreement or any law; or (c) infringement of any third‑party right.

19. Force Majeure

SNF is not liable for failure to perform caused by events beyond its reasonable control, including but not limited to, natural disasters, war, terrorism, labour disruptions, pandemics, or governmental actions.

20. Third‑Party Links & Services

The Site may contain links to third‑party websites or services. SNF does not control and is not responsible for the content, privacy practices, or performance of third‑party sites. Access at your own risk.

21. Suspension & Termination

SNF may suspend or terminate your account or access to the Services at any time, with or without notice, for conduct that SNF believes violates this Agreement or is otherwise harmful. Upon termination, your license terminates and you must cease use of the Content.

22. Modifications to the Agreement

We may revise this Agreement at any time by posting the updated version on the Site and updating the “Last Updated” date. Material changes will be highlighted for at least 30 days. Your continued use after changes constitutes acceptance.

23. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws principles. You irrevocably submit to the exclusive jurisdiction of the courts located in Halifax, Nova Scotia.

24. Severability

If any provision of this Agreement is held invalid or unenforceable, the remainder shall remain in full force, and the invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

25. Assignment

You may not assign or transfer this Agreement without SNF’s prior written consent. SNF may assign this Agreement at its sole discretion.
